Nawaz prevented filing of appeal in Hudaibiya case, NAB tells apex court
The National Accountability Bureau (NAB) has apprised the Supreme Court (SC) on Wednesday that ousted prime minister Nawaz Sharif being in power at the time had prevented an appeal from being filed in the Supreme Court (SC) in the Hudabiya Paper Mills reference against the Sharif family.
Nab’s Deputy Prosecutor Imranul Haq has filed a new application explaining the delay in filing of appeal against a three-year-old Lahore High Court verdict to quash references against the Sharif family.
A three-judge bench of the top court – headed by Justice Mushir Alam and comprising Justice Qazi Faez Isa and Justice Mazhar Alam Khan Miankhel is hearing NAB’s appeal against the LHC order.
The anti-graft watchdog in its application has stated that that now when the matter is before the SC, justice calls that the “impugned judgment be scrutinised on the touchstone of precedents” settled by the top court. “No doubt an accused is the favourite child of law, but keeping in view the shape of scale of justice the complaint is also not devoid of the court’s justice,” stated the application.
The plea further states that the irresponsible decision of the judges should not affect the prosecution case. “Denial of reinvestigation amounted to denial of justice itself, hence the justice was castrated, damage should be undone by this honourable court by condoning the delay in filing of petition,” it demanded.
The NAB has also pleaded before the Supreme Court to ignore its delay in filing the appeal and permit the bureau to reopen the case.
The Supreme Court on Tuesday had sought a complete record of the Hudaibiya Paper Mills reference and adjourned the proceedings till Dec 11 after NAB Deputy Prosecutor Imranul Haq had asked for more time to prepare for the case. The NAB’s response comes a day after the SC hearing during which the bench had asked NAB to state how the Sharif family had used influence to quash the Hudaibiya Paper Mills case.
